A 2008 accident at a ski resort in Nova Scotia, Canada will result in a lawsuit going forward against the resort operator and the snowboard manufacturer involved, despite the defence efforts to end the matter before a trial with a motion for summary dismissal of the claims.

Injuries sustained by the snowboarder resulted in the paralysis of the 16 year old plaintiff. Claims allege negligence against the snowboard manufacturer and ski resort in that the plaintiff was not warned about the potential dangers of using a snowboard in the terrain park, even though a waiver of liability may have been signed.
